This Privacy Policy describes how [Whale TV PTE. LTD.] ("we," "us," or "our") processes your personal information when you use our product and services including Uhale, Whale Framely and related applications provided by [Whale TV PTE. LTD.], [headquartered at 6 RAFFLES QUAY #14-02, Singapore (048580)], as the data controller responsible for data protection. Unless specifically stated otherwise, the information provided in this Privacy Policy applies to both our services and the website. We are committed to providing quality services and a safe environment to users. This Privacy Policy is meant to help consumers (“you”) understand what information we collect, why it is collected and how the information is used and shared.

Where it is reasonable and practicable to do so, we will collect your personal information only from yourself. However, in some circumstances, we might be provided with information by third parties. This Privacy Policy does not cover actions of third parties. For more information about their practices, please consult their privacy policies. We are not responsible for it.

Why We Collect Information

To enable building of better services and improvement of our services, we need to collect your personal information. Personal information collected by us is used for the following purposes:

  1. Support and maintenance: to provide you with quality and maintenance services, and to handle and meet your requirements.
  2. Improve our products and services: we use your information to make improvements in our products and services.  
  3. Develop new services: we use the information we collect in existing services to help us develop new ones.
  4. Service communications and customer cares.
  5. Protect users, the public and us: we use collected information to help improving safety and reliability of our services. This includes protecting, detecting and deterring fraudulent, unauthorized, infringing or illegal activities that could harm us, our users or the public.
  6. To comply with the law and legal processes.
  7. Your name, email, and your Google® account information if you signed into Google Photos within the Uhale mobile application (we do not have access to your Google password)

Third Party Data Processing

We may use other analytic means to evaluate our Services. We use these tools to help us improve our Services, performance and user experiences.

Specifically we utilize the following services:

Amazon EC2 (Virtual servers in the cloud)

Amazon Simple Storage Service (S3) (Scalable storage in the cloud)

Amazon RDS(Managed relational database service for MySQL, PostgreSQL, Oracle, SQL Server, and MariaDB)

Amazon MQ (Managed message broker service)

Amazon Simple Queue Service (SQS) (Managed message queues)

AWS IoT (IoT services for industrial, consumer, and commercial solutions)

Google Photos: Uhale also allows users to connect their Google Photos account to upload photographs from Google Photos to the Services. Uhale does not own your photos. Uhale will never use your photos for any purpose other than providing you with the Services. Uhale will never sell or publish any of your photos without your explicit permission and consent.

We Want You to Understand Types of Information We Collect as You Use Our Services

We collect information to provide better services to all our users. Photos shared through the app are never collected or seen by us or third parties. What information we collect and how that information is used depends on how you use our services and how you manage your privacy controls. We may collect information from you, such as:

Device Information

In order to provide you with basic smart device services, we may collect device information when you use our services. We may collect MAC-Address, device type and settings, device-ID, Wi-Fi network name and connection data, country and language configured on your smart device, time and date of server accessing, error logs, crash reports, software version numbers.

Your Location

We will collect your location information when you use our services so that we can provide you some convenient and practical services. You may opt out of collection of location information via device level settings.

We will not share your personal information with any companies, organizations or individuals except in the following cases:

We’ll share your personal information when we have your consent. We’ll ask for your explicit consent to share any sensitive personal information.

We will share your personal information if we have a good-faith belief that accesses, uses, preservation or disclosures of such information are reasonably necessary to:

(i) Meet any applicable law, regulation, legal process or enforceable governmental request;

(ii) Enforce applicable terms of services, including investigations of potential violations;

(iii) Detect, prevent or otherwise address frauds, security or technical issues;

(iv) Protect against harms to rights, properties or safety of us, our users or the public as required or permitted by law.

For External Processing

We provide personal information to our affiliates and other trusted businesses partners to process the personal information for us based on our instructions and in compliance with our Privacy Policy under appropriate confidentiality or security measure.  

We use and combine the information we collect about you from our Services, devices, or other sources to provide you with a better experience. You have choices about your information. Check out the You Are in Control section to learn more.

If you give consent, you can always revoke by contacting us as specified in the CONTACT US section of this Privacy Policy.

3. Transfer of your Personal Information

Subject to applicable law, we may transfer your Personal Information from your home country to other companies that belong to us or to our service providers around the world. When we transfer this data, we will do so only when we have put in place appropriate and legal contracts and safeguards to protect your Personal Data. If you are an EU resident, please note that we will not transfer your data to other locations outside of Europe.

We maintain servers in some different countries and your information may be processed on servers located out of the country where you live. Data protection laws vary among countries, of which some provide more protections than others. You consent to transfer of information to countries out of your country of residence, which may have different data protection rules compared with those in your country. Regardless of where your information is processed, we apply the same protections described in this policy. We also comply with certain legal frameworks related to transfers of data.

We share your personal information according to this Privacy Policy, with your consent or as necessary to provide you the products and services you request, as well as to operate our business. The ways in which we share your personal information are set forth below.

Service Providers We may share your personal information with service providers who perform services for us. We do not authorize our service providers to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements

Affiliates We may share your personal information with our subsidiaries.

Business Partners We may share your personal information with our business partners, such as wireless carriers, as well as third parties who operate apps and services that connect with certain of the Services.

Consent We may share personal information we collect through the Services if you ask us to do so or otherwise with your consent.

Legal Compliance and Security Reasons We also may disclose information about you in other circumstances, including (1) if we are required to do so by law or legal process, (2) to law enforcement authorities or other government officials, (3) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.

Merger, Acquisition or Other Fundamental Corporate Changes In the event we may or do sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation).

5. How Secure is Your Personal Information?

We use industry-standard methods to secure its electronic databases of personal information. However, you should know that no company, including us, can fully eliminate security risks associated with personal information. All products are built with strong security features that continuously protect your information. Insights we gain from maintenance of our services help us detect and automatically block security threats from ever reaching you. what’s more, if we do detect something risky that we think you should know about, we’ll notify you and help guiding you through steps to be better protected.

We work hard to protect you and us through unauthorized accesses, alterations, disclosures or destruction of information we hold, including:

(i) We use encryption to keep your data private in transit;

(ii) We review our information collections, storage and processing practices to prevent unauthorized accesses to our systems;

(iii) We restrict accesses to personal information of our employees, service providers and vendors who need that information in order to process it. Anyone with this access is subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet those obligations.

However, please note that although we take reasonable steps to protect your information, no Internet transmission, computer system, or wireless connection is completely secure.

6. How Long do We Store Personal Information?

We won’t keep your personal information for longer than is necessary for the purpose for which it was collected. This means that information will be destroyed or erased from our systems when it’s no longer required. Once you have transferred your photo to the photo frame, our application will delete it immediately.

We take appropriate steps to ensure that we process and retain information about you based on the following logic:

(i) At least the duration for which the information is used to provide you with a service;

(ii) As required under law, a contract, or with regard to our statutory obligations;

(iii) Only for as long as is necessary for the purpose for which it was collected, is processed, or longer if required under any contract, by applicable law, or for statistical purposes, subject to appropriate safeguards.

We generally store personal data as long as it is needed to provide services to you, unless we publish elsewhere in this policy that we store it for a shorter or longer period. We may store (aggregated) data longer if it is needed for taxes or auditing issues.

7. Data Subject Rights

Your personal information belongs to you. You can ask us to provide details about what we’ve collected, and you can ask us to delete it or correct any inaccuracies.

You have the right to request accesses to your personal information that we process. You also have rights to:

(a) Rectify incorrect personal data or erase it in certain circumstances.

(b) Restrict or object to processing of your personal data.

(c) Right to erase and “right to be forgotten”.

(d) Receive your data so that you can use it elsewhere (data portability).

You also have the right to withdraw your consent any time but we would like to point out that this does not affect the lawfulness of processing before the date on which you withdraw your consent.

You can also use the relevant functionality provided in the software to remove all cookies and login details. However, requesting the deletion of your personal information may also result in a loss of access to Services we provide. We won’t delete data that we’re required by law to retain. If you wish to opt out of interest-based advertising, please click here; or if you are located in the European Union, please click here. Please note you will continue to receive generic ads. You may opt-out from receiving marketing-related emails or notifications through the email selection or other communications from us on a going-forward basis as specified in the "Contact Us" section of this Privacy Policy. We will comply with your opt-out request as soon as reasonably practicable.

8. Children’s Personal Information

Unless otherwise specified, the Services are designed for a general audience and are not directed to children. In connection with the Services, we do not knowingly solicit or collect personal information from minors as defined by applicable law without parental consent. If we learn that we have collected personal information from a minor as defined by applicable law without parental consent, we will promptly delete that information. If you believe that a an minor as defined by applicable law has provided us with personal information without parental consent, please contact us as specified in the Contact Us section of this Privacy Policy.

9. Updates

This Privacy Notice may be updated periodically to reflect changes in our personal information practices with respect to our Service or changes in the applicable law. We will post a notice on our website and/or your device to notify you of any significant changes to our Privacy Notice, and indicate at the top of the notice when it was most recently updated.
